Biography

Since entering private practice, the primary focus of Ms. Tyson's practice has been workouts, bankruptcy and related commercial litigation. Ms. Tyson represents clients in virtually every aspect of a bankruptcy case. She represents secured and unsecured creditors in Chapter 7, 11 and 13 proceedings and unsecured creditors committees in Chapter 11 proceedings. Several of these representations involved bankruptcies of companies with significant foreign operations and assets. In addition, Ms. Tyson represents Chapter 7 trustees as well as individuals appointed under Chapter 11 plans of reorganization to perform essentially the duties of a Chapter 7 trustee. While the majority of her bankruptcy practice addresses issues arising after a bankruptcy filing, Ms. Tyson frequently advises clients regarding potential bankruptcy issues in connection with the negotiation of business, real estate and public finance transactions.

In addition to her bankruptcy practice, Ms. Tyson represents clients in a variety of other business disputes including contract, tort, fraudulent transfer and construction claims arising in federal and state court.

Ms. Tyson is a former law clerk to the Honorable John K. Pearson of the United States Bankruptcy Court for the District of Kansas (1989-1991) and to the Honorable Jerry G. Elliott of the Kansas Court of Appeals (1987-1989).

Accomplishments

Represented largest unsecured creditor in Chapter 11 case resulting in payment of over 100% of client's $1,600,000 claim.

Counseled client in successful purchase of medical supply business out of bankruptcy estate.

Assisted secured creditor in retaining state court receiver and obtaining relief from the automatic stay within 40 days of the bankruptcy filing which permitted client to conclude foreclosure action.

Served as Chapter 7 trustee's counsel in administration of regional airline's bankruptcy managing over 300 lawsuits resulting in creditors receiving 3 times anticipated distribution.

Defended bank against lender liability claims, securing a $2,400,000 payment to bank and dismissal of all claims.

Supervised 45 contract attorneys and paralegals in the collection, review and production of millions of documents in connection with government investigation.
